General Terms and Conditions of We guide Leipzig
1. Conclusion of a contract
With the application, which can be made in writing, verbally, by telephone or by fax, the customer We guide Leipzig offers the conclusion of a contract binding. By booking, the customer accepts the terms and conditions. In the case of a registration for several participants, the applicant is liable in addition to these participants for their contractual obligations as for his own. The contract is concluded when the customer has confirmed the written offer of the organizer by signature.
2. Execution of city tours, sightseeing tours etc.
The maximum group size for public tours, city excursions by bike or public transport is 14 people. Routes and program changes may arise from given circumstances (eg construction measures, road closures, weather etc.) or for necessary organizational reasons. The tour guide is obliged to observe a waiting period of 15 minutes from the agreed time. For group tours, which are to be extended on request, 30 € per half hour will be charged additionally.
In the event of late arrival of a group, a waiting allowance i. H. v. 20,00 € due if the tour is not shortened by the waiting time). In the case of intentional recording of a tour, the written permission of We guide Leipzig must be obtained in advance.
Our city tours take place even in bad weather and rain. Our guests are requested to be equipped and dressed according to the weather.
2.1. Services, changes in performance
The scope of the contractual services results from the service description of We guide Leipzig. The abolition of individual services does not entitle to the retention of the contract amount or partial deduction, as far as there are reasons that are not to be represented by We guide Leipzig. If the abolition of individual services by We guide Leipzig is responsible, We guide Leipzig has the right to replace these services with equivalent other services. We guide Leipzig is obliged to inform the customer thereof. If necessary, the customer is offered a free rebooking or a free withdrawal from the contract.
3. Payment
3.1. on public tours
Unless otherwise agreed, the agreed and published by us ticket price is paid directly to the tour guide. There is a minimum number of participants of 5 persons.
3.2. at group tours
After conclusion of the contract, a down payment is due, which is to be paid in the amount of 20% of the travel price. The remaining travel price is due no later than 4 weeks before departure.
4. Withdrawal, termination and rebooking by the customer on public tours
Execution in case of failure to reach the minimum number of participants is at the discretion of We guide Leipzig. For the tours of the partner companies, the terms and conditions of the respective company apply, which can be requested from We guide Leipzig.
If the guest withdraws from the ticket after the ticket has been purchased, it is possible to exchange the ticket for an equivalent tour or vouchers for free. If an exchange is not desired, the following cancellation scale applies (the receipt of the declaration of withdrawal (by fax, telephone or email) or the return of the ticket is decisive:
free of charge until 6 days before the event
up to 3 days before the event 15% of the agreed price
until 1 working day before the event 50% of the agreed price
less than 1 working day or no show 100% of the agreed price
If additional services are booked (eg transport, entertainment, etc.) that We guide Leipzig receives from other service providers, the cancellation conditions in paragraph 5 shall apply.
5. Withdrawal, termination and rebooking by the customer on city tours by bicycle, bus, tram and boat (group bookings)
The customer can withdraw from the contract before departure. If he accepts this possibility, the organizer has a claim on the agreed rental price or a claim for appropriate compensation. This means for all contracts with We guide Leipzig in a resignation:
up to 31 days before the planned departure free of charge
up to 30 days before the planned departure 10% of the agreed price
from 20 to 11 days before the planned departure 25% of the agreed price
from 10 days before the planned departure 50% of the agreed price
from 5 days before the planned departure 100% of the agreed price
When booking additional services that We guide Leipzig receives from other service providers (transport, hospitality, etc.), the cancellation conditions of the respective service partners apply. For rebooking a separate fee (depending on the effort) is charged.
We guide Leipzig is responsible as an organizer for the conscientious preparation of the event, the careful selection and monitoring of the cooperation partners and the proper provision of the contractually agreed service. We guide Leipzig is not liable for third-party services of other service providers, which are only provided by us (promotion, museum or exhibition visits, hospitality, etc.).
The customer can demand remedy, if services are not provided according to the tender or contract. The notification of the defect must be made immediately by phone at 0157/52041275, so that remedial action can be taken.
We guide Leipzig is not liable for personal items left or lost during the events.
Be the change of routes or content due to circumstances such as construction, bad weather, road closures, etc. necessary, the organizer can not be held liable. For boat trips there are special cancellation conditions, which are attached to the contract.
Withdrawal
You have the right to withdraw from this contract within 14 days without giving reasons. The cancellation period is 14 days from the date of the contract.
In order to exercise your right of revocation, you must inform us (We guide Leipzig, Robert Tittel, Scheffelstrasse 18 04277 Leipzig, info@we-guide-leipzig.com) by means of a clear statement (eg a letter sent by post, fax or email) about your decision to withdraw from this contract. You can use the enclosed model withdrawal form, which is not provided for.
In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the cancellation
If you withdraw from this Agreement, I will have you all the payments I have received from you, including the delivery charges (except for the additional costs arising from choosing a different delivery method than the cheapest standard delivery we offer) have to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached me. 7. Jurisdiction
Jurisdiction of the service provision is Leipzig.
8. Privacy
The customer agrees that the data provided for the processing of the agreed service will continue to be used by We Guide Leipzig for customer service. These data are not passed on to third parties within the meaning of the Federal Data Protection Act.
9. Alternative dispute resolution
The EU Commission has provided a platform for out-of-court dispute resolution. This gives consumers the opportunity to settle disputes in connection with their online order without the intervention of a court. We endeavor to settle any disputes arising from our contract by mutual agreement. In addition, we are not obligated to participate in a conciliation procedure and unfortunately can not offer you participation in such a procedure.
10. Severability clause
Should one or more conditions of this contract be ineffective, this will not affect the validity of the remaining conditions. In the place of the ineffective conditions the one as agreed, which corresponds to the meaning and purpose of the ineffective condition. The general business conditions apply starting from the 1. September 2019.
